The aforementioned company (hereinafter referred to as HOTEL CJ) sells hotel services and provides information about HOTEL CIUTAT JARDI through the website www.hciutatj.es (the "Website"). Transactions made through the Website will be invoiced by ART I TURISME S.L., with which the contract is deemed to have been entered into. These Terms and Conditions apply to the aforementioned company. By using the Website and contracting the services (the "Services") offered therein, its users and/or clients (hereinafter, both referred to interchangeably as "User" or "Users") accept the General Terms and Conditions, the Specific Terms and Conditions defined in the purchasing process, and the Privacy Policy, which are updated periodically. Therefore, it is important that the User reads them each time they visit the Website, as well as all the specific terms and conditions for each Service, which must also be accepted. Simply browsing the Website does not constitute any agreement between HOTEL CJ and the User. Through the Website, HOTEL CJ offers information related to the Services it markets. The Website offers information about the hotel marketed by ART I TURISME S.L. By accessing and using the Website, the User agrees to accept the general terms and conditions set forth below (the "Terms and Conditions"). Therefore, it is recommended that you read this section carefully before proceeding. HOTEL CJ reserves the right to change, modify, add, or remove any part of the Terms and Conditions at any time and to make changes to the Services without prior notice. All technical means and requirements required to access the Website and the Services shall be the sole responsibility of the User, as well as any expenses or taxes that may arise from the provision of the Services. 2. EXCLUSION OF LIABILITY HOTEL CJ is not responsible for any damages or losses arising from access, use, or misuse of the Website's contents. Use of the Website is at the User's own risk. Neither HOTEL CJ nor its representatives or agents shall be liable for any loss or harm, whether direct or indirect, special or consequential, in any way connected with or resulting from the use of the Website or any information contained therein. By accepting the Terms and Conditions, the User expressly waives any claim against HOTEL CJ arising from the use of the Website or the information contained therein. 3. LIABILITY FOR CONTENT HOTEL CJ is not responsible for any discrepancies that may arise between the printed version of its documents and the electronic version published on the Website. The documents and photographs published on the Website may include technical inconsistencies or typographical errors. The information is subject to periodic changes, and HOTEL CJ may make improvements or changes to the Services described herein at any time. HOTEL CJ is not responsible for the accuracy of information not of its own creation, nor does it assume any liability for any damages that may arise from the use of said information. 4. INDUSTRIAL AND INTELLECTUAL PROPERTY This page contains and refers to the industrial or intellectual property rights of HOTEL CJ i ART I TURISME S.L. All content on this page, including text, graphics, logos, icons, images, data compilations, and software, is the exclusive property of HOTEL CJ and is protected by international copyright laws. HOTEL CJ reserves the right to pursue civil and/or criminal legal actions against any natural or legal persons and their representatives who violate the provisions of the Terms and Conditions, especially with regard to copyright. The website is not intended for distribution, use, or access by persons in jurisdictions where accessing this page would cause HOTEL CJ to violate any law or regulation in that jurisdiction. 5. AGE OF MAJORITY AND LEGAL CAPACITY The User declares that he or she is of legal age (over 18 years of age or 21 in some jurisdictions) and has the necessary legal capacity to contract the Services offered on the Website in accordance with the Terms and Conditions, which he or she understands and fully understands. In the event of a contract by a minor, HOTEL CJ shall not be liable under any circumstances, and the minor, his or her parents, or guardians shall be responsible for any costs and consequences that this may entail. Access to the Website is the sole responsibility of the User. 6. ACCEPTANCE OF CONDITIONS Once the User has accessed the Website, in order to contract the Services, he or she must follow all the instructions and indications contained in the purchase procedure, completing the Specific Terms and Conditions and other forms established for each Service. This will imply reading and accepting all the applicable General and Specific Terms and Conditions. By checking in to accept the Terms and Conditions, the User confirms their contract with HOTEL CJ, confirming the dates indicated in their reservation, the number of rooms and guests, and any other Specific Conditions of Service detailed in the purchase process. The User agrees to confirm the truthfulness and accuracy of the information provided. Any contract for which the User has provided false information is void. The Hotel will not accept vouchers or confirmation documents resulting from false information. In cases where the User has made a reservation with false information, they will be responsible for the processing and operating costs incurred by their reservation and will indemnify the hotel for any lost profits resulting from the reservation of rooms that were ultimately not booked by the User or any third party. The contracted Terms and Conditions of the reservation are those expressly determined in the purchase process. HOTEL CJ reserves the right to modify prices upon prior notice to the User. Once the reservation has been made, HOTEL CJ will send the User the receipts and/or documents applicable to the specific reservation by email. These Terms and Conditions, the specific terms and conditions of sale for the rate reserved by the User, and the voucher or reservation request express the entirety of the obligations between the parties. No general or specific conditions communicated by the User may be incorporated into these Terms and Conditions. The documents comprising the contractual commitments between the parties are, in decreasing order of priority, the voucher or reservation request (including the specific conditions of the reserved rate) and these Terms and Conditions. In the event of a contradiction between the reservation voucher and the Terms and Conditions, the provisions of the reservation voucher will be solely applicable to the obligation in question. 7. RATES AND BILLING The itemized rate will show the final price of the contracted Service, indirect taxes, or any other fees or taxes applicable in the country where the Service is provided. Some countries require fees for entry and/or exit from their territory, which must be paid by the User as a tourist or visitor. These fees must be collected by HOTEL CJ, who must then remit them to the government of that country. HOTEL CJ will make every effort to ensure that the User is informed of these fees prior to booking. In such cases, the User accepts full and exclusive responsibility for all fees arising from their trip, such as port and airport taxes, visa fees, etc. One euro (€1.00)—or equivalent currency according to the exchange rate on the day of booking—may be charged to the User's card at the time of booking to verify the validity of said payment method. The euro charged will be deducted from the total amount of the reservation. HOTEL CJ will never send Users invoices, vouchers, or other documents related to the reservation in paper format. The User accepts HOTEL CJ's commitment to the environment and therefore agrees to the electronic method of receiving documents. Prices related to the reservation of the Services are indicated before and during the reservation. Prices are expressed per room, number of people, and for the selected date. Prices are confirmed to the User, including all taxes, in the Hotel's commercial currency (which in certain cases may be different from the Hotel's local currency) and are valid only for the period indicated on the Website. All reservations, regardless of their origin, must be paid in the Hotel's currency, unless specifically indicated by the Hotel. Currency conversion is indicated for information purposes only and is not contractual. Only the currency confirmed at the time of reservation is guaranteed (if this currency is different from the Hotel's currency, any possible currency exchange costs will be borne by the User). 8. PAYMENT METHODS HOTEL CJ will indicate the available payment method on the reservation form, depending on the advance notice period. The User must make the payment using any of the offered methods. Depending on the advance notice period and the Hotel, the payment methods offered may be the following: Payment by credit card. This payment method may be made in the following ways: The full amount of the reservation price at the time of confirming the reservation. Partial payment: At the time of booking, the percentage indicated in the reservation details will be paid, and before the date indicated in the same details, the remaining percentage of the price will be paid. All of this is understood to mean that if the second payment is not made within the indicated period, it will be treated as a cancellation. Under no circumstances is it guaranteed that the payment method used to pay the initial percentage can be used to pay the remaining percentage of the price. In the case of a card payment in which the cardholder is not the person making the reservation, the cardholder must provide additional information beyond that required during the purchase process. If this information is not provided correctly, payment must be made at the hotel. If it is not provided, the reservation will not be valid. Payment at Destination: Payment may be made at the destination by the User in cash or by card upon arrival at the Hotel. In such cases, the User must enter the purchaser's card details as a guarantee for the reservation. In the event of a no-show or modification, HOTEL CJ will charge the penalties indicated on the Website. Under no circumstances is it guaranteed that the payment method used for the initial guarantee can be used for payment at the destination. Phone Payment: The User, if the computer system allows it, may make payment by phone call to the call center at the number indicated on the Website. The timeframe for confirmation and payment of the reservation will not exceed 3 hours from the moment the reservation is made. In the event that telephone confirmation is not made within the specified timeframe, HOTEL CJ reserves the right to cancel the reservation without any further request or demand from the User. The User must confirm their credit and/or debit card details by telephone, expressly accepting that said card will be charged for the reservation price, as well as any cancellation and/or modification fees or refunds, if applicable. The User agrees that the payment method used is their own and that the information provided is correct.
